NovaMind — Terms of Service
These Terms of Service ("Terms") govern your access to and use of NovaMind (the "Service"), the creative-technology knowledge assistant available at novamind.design, operated by the NovaMind team (the "Operator", "we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
NovaMind is a research and learning assistant for creative-technology domains (including TouchDesigner, DaVinci Resolve, Resolume, Ableton, color science, and related topics). It retrieves material from a curated corpus and uses large language models to generate answers with citations.
2. Accounts and invite codes
- Access is by invitation. An invite code may be used to create exactly one account; once claimed, the code becomes your personal login credential.
- You are responsible for keeping your invite code confidential. Do not share it — anyone holding your code can access your account, and sharing may result in suspension.
- You must provide a display name; an email address is optional and, if provided, is used only so we can contact you about the Service.
- We may suspend or disable accounts that violate these Terms.
3. Acceptable use
You agree not to:
- probe, scan, or attempt to breach the Service's security, rate limits, or authentication, or attempt to extract its underlying systems, prompts, models, datasets, or infrastructure details;
- use automated means to access the Service beyond your own reasonable personal use, or resell or redistribute access;
- submit content that is unlawful, infringing, or malicious, or use the Service to generate content for unlawful purposes;
- interfere with other users' use of the Service.
4. AI-generated content
- Answers are generated by machine-learning systems and may be inaccurate, incomplete, or outdated despite citations. They are provided for information only and are not professional advice.
- Verify anything important against primary sources (vendor documentation, manuals) before relying on it — especially for work affecting production systems, deliverables, or purchases.
- Cited excerpts remain the property of their respective rights holders; citations identify sources and do not transfer any rights.
5. Your content
- You retain any rights you hold in the queries and content you submit.
- You grant us a non-exclusive license to process, store, and display your submissions as needed to operate, secure, and improve the Service (including conversation history and the per-user memory features).
- To the extent we hold any rights in generated answers, we do not assert them against your use of answers you received.
6. Privacy and data we keep
To operate the Service we store: your account record (display name, optional email), your conversation history and saved memory entries, and operational logs of your usage — including login events, query counts, model token usage and cost, approximate network address, and feedback you submit. We use this data to run, secure, meter, and improve the Service. We do not sell it. Queries are processed by third-party model providers (see §7) as necessary to generate answers. To request deletion of your account and associated data, contact us (§12).
7. Third-party services
The Service depends on third-party infrastructure and model providers (for hosting, language-model inference, embeddings, and reranking). Your queries are transmitted to such providers for processing under their own terms. We choose providers with reasonable care but are not responsible for their acts or omissions.
8. Availability
The Service is provided on a best-effort basis, without uptime commitments. We may modify, rate-limit, suspend, or discontinue the Service (in whole or in part) at any time.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND UNINTERRUPTED OPERATION.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF US$50 OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access for violation of these Terms, for security reasons, or upon discontinuation of the Service. Sections 4-10 and 13 survive termination.

13. Changes to these Terms; general
- We may update these Terms. Material changes take effect when we publish a new version and ask you to accept it at your next sign-in; continued use after acceptance constitutes agreement.
- If any provision is unenforceable, the remainder stays in effect. These Terms are the entire agreement between you and the Operator regarding the Service.
- These Terms are governed by the laws of the Operator's place of residence, without regard to conflict-of-law rules, and disputes shall be resolved in the courts of that jurisdiction.
